1. Definitions
- "Waja Law" — the legal practice operating under that name from Suite 2-2, Tamarind Square, Persiaran Multimedia, 63000 Cyberjaya, Selangor.
- "Website" — the website located at https://wajalaww.info and all pages and subpages thereof.
- "User" — any person accessing or using the Website.
- "Services" — the legal services described on the Website, including construction contract review, CIPAA adjudication representation, and arbitration or High Court dispute handling.
- "Engagement" — a formal retainer entered into between Waja Law and a client under a written engagement letter.
2. Acceptance of Terms
By accessing and using the Website, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Website. These Terms do not constitute a solicitor-client relationship. A formal Engagement requires a separate written retainer agreement.
You must be at least 18 years of age and have the legal capacity to enter into an agreement in Malaysia to engage Waja Law's services.
3. Nature of Website Content
The content on this Website is provided for general informational purposes only. Nothing on the Website constitutes legal advice. Descriptions of the law, legal procedures, or services are general in nature and may not apply to your specific circumstances.
Waja Law does not warrant that the information on the Website is accurate, complete, or up to date. Construction law and CIPAA practice are subject to legislative and judicial development.
4. Services
Waja Law provides legal services in Malaysia relating to construction law. Services are available to businesses and individuals in Peninsular Malaysia. The practice does not provide legal services in East Malaysia (Sabah and Sarawak) without prior arrangement.
Service availability, scope and pricing are set out on the Website as general guidance. Final scope and fees are confirmed in a written engagement letter before work begins.
5. Enquiries and No Client Relationship
Submitting an enquiry through the Website contact form or by email does not create a solicitor-client relationship. A relationship is only formed upon execution of a written engagement letter. Until then, Waja Law is under no obligation to maintain confidentiality with respect to information shared in initial enquiries (though we treat all enquiries with discretion as a matter of professional practice).
6. User Responsibilities
Users of the Website must not:
- Use the Website for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Website
- Transmit harmful, offensive or misleading content through the contact form
- Reproduce Website content without prior written permission
7. Intellectual Property
All content on the Website — including text, layout, logos and design — is the intellectual property of Waja Law or its licensors. Users are granted a limited, non-exclusive licence to access and view the Website for personal, non-commercial purposes only. No content may be reproduced, distributed or adapted without written permission.
8. Payment Terms for Engaged Services
Fees and payment terms are as set out in the written engagement letter for each matter. General guidance on fees is provided on the Website but is not contractually binding. Fees are quoted in Malaysian Ringgit (RM). Invoices are payable within 14 days of issue unless otherwise agreed.
Waja Law does not offer refunds for legal work already completed and delivered. If you have concerns about a delivered work product, please raise them with us directly within 14 days of delivery.
9. Service-Specific Terms — Legal Services
- Contract Review: delivered as a written commentary document. The review reflects the contract as provided. Changes to the contract after delivery are not covered by the original fee.
- CIPAA Adjudication: subject to CIPAA 2012 and AIAC Adjudication Rules. Waja Law will advise on realistic outcomes but cannot predict or warrant the adjudicator's decision.
- Arbitration / Court: subject to AIAC Arbitration Rules or the Rules of the High Court as applicable. Duration and cost are subject to the conduct of the other party and the tribunal's scheduling.
10. Disclaimers
Waja Law provides services with reasonable professional care and skill. However, legal proceedings inherently involve uncertainty. The practice does not warrant or represent that any particular outcome will be achieved in adjudication, arbitration or court proceedings.
The Website is provided "as is" without warranty of any kind regarding availability, accuracy or fitness for a particular purpose.
11. Limitation of Liability
To the extent permitted by Malaysian law, Waja Law's aggregate liability to any user or client in connection with the Website or services provided under these Terms shall not exceed the fees paid for the relevant service in the preceding 12 months. Waja Law is not liable for indirect, consequential, or incidental loss.
Nothing in these Terms limits liability for fraud, wilful default, or any liability that cannot be excluded by law.
12. Termination
Either party may terminate a matter engagement on reasonable written notice, subject to the terms of the written engagement letter. Waja Law reserves the right to cease acting in circumstances required by the Bar Council's Professional Practice Directions (for example, conflict of interest).
Upon termination, fees for work completed to the date of termination remain payable.
13. Dispute Resolution
Any dispute arising out of the use of the Website or the engagement of services shall be governed by the laws of Malaysia. The parties agree to submit to the exclusive jurisdiction of the courts of Malaysia. Before commencing court proceedings, parties agree to attempt informal resolution by written notice and a 30-day negotiation period.
14. General Provisions
- Entire agreement: these Terms, together with the written engagement letter (where applicable), constitute the entire agreement between the parties.
- Severability: if any provision is held unenforceable, the remaining provisions continue in full force.
- Waiver: failure to enforce any provision does not constitute a waiver of the right to do so in future.
- Notices: legal notices to Waja Law should be sent in writing to the office address or to [email protected].
15. Changes to These Terms
Waja Law may update these Terms from time to time. The "Last Updated" date above indicates the most recent version. Continued use of the Website after changes constitutes acceptance of the revised Terms.
